1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the mobile games and related services (collectively, "Games" or "Services") provided by Cool Beans Games ("we," "us," or "our"). By downloading, installing, accessing, or using our Games, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Games.

2. Description of Services

Cool Beans Games develops and publishes free-to-play casual mobile games, including puzzle games, word games, and other entertainment applications. Our Games are available for download on the Google Play Store and may be made available on other platforms in the future.

Our Games are free to download and play. They are supported by advertisements displayed within the Games.

3. Licence to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use our Games on your personal mobile device for your personal, non-commercial entertainment purposes, subject to these Terms.

You may not:

a) Copy, modify, distribute, sell, lease, or sublicence our Games or any part of them.

b) Reverse engineer, decompile, disassemble, or attempt to derive the source code of our Games.

c) Remove, alter, or obscure any copyright, trademark, or other proprietary notices in our Games.

d) Use our Games for any unlawful or unauthorised purpose.

e) Use automated scripts, bots, or other tools to interact with our Games.

f) Attempt to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running our Games.

All content, features, and functionality of our Games, including but not limited to the software, text, graphics, logos, icons, images, audio, game mechanics, and user interface design, are owned by Cool Beans Games or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Cool Beans Games name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cool Beans Games. You may not use these marks without our prior written permission.

5. Advertising

Our Games display third-party advertisements to provide the Games free of charge. By using our Games, you acknowledge and agree that:

a) Advertisements will be displayed during gameplay, including but not limited to banner ads, interstitial ads, and rewarded video ads.

b) We and our advertising partners may collect certain information as described in our Privacy Policy to serve advertisements.

c) You may have the option to consent to or opt out of personalised advertising as described in our Privacy Policy.

d) We are not responsible for the content of third-party advertisements or the products or services they promote. Interacting with advertisements is at your own risk.

6. User Conduct

You agree to use our Games only for lawful purposes and in accordance with these Terms. You agree not to:

8. Disclaimer of Warranties

OUR GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that our Games will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We do not warrant that the results obtained from the use of our Games will be accurate or reliable.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COOL BEANS GAMES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

b) Any conduct or content of any third party in connection with our Games, including any defamatory, offensive, or illegal conduct.

c) Any content or advertisements obtained from or through our Games.

d) Unauthorised access, use, or alteration of your data or transmissions.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

You agree to indemnify, defend, and hold harmless Cool Beans Games and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our Games or your violation of these Terms.

11. Third-Party Services and Links

Our Games may contain links to third-party websites, services, or content, including through advertisements. We are not responsible for the content, privacy practices, or terms of service of any third-party services. Your interactions with third-party services are governed by their own terms and policies.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

If you are a consumer in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

If you are a consumer in the European Union, you may also bring proceedings in the courts of the country in which you are domiciled. For EU consumers, the European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

For residents of California, if a dispute cannot be resolved informally, both parties agree to attempt to resolve the dispute through binding arbitration conducted on an individual basis, except where prohibited by law. You retain the right to bring claims in small claims court if your claims qualify.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of our Games and supersede any prior agreements or understandings.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of these Terms. Your continued use of our Games after any changes constitutes your acceptance of the revised Terms.
